1. About ClayLine ClayLine ("ClayLine", "we", "us", "the Service") is a mobile application and website that helps users turn automotive sketches and ideas into AI-assisted concept visuals, share work with a community, and join design challenges.
2. Acceptance By downloading, accessing, or using ClayLine, you agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.
3. Eligibility You must meet the minimum age required to use online services in your country (typically at least 13 years old). If you are under 18, you represent that you have permission from a parent or guardian.
4. AI-Generated Content 4.1 The Service uses third-party artificial intelligence systems to produce images and related outputs ("Generated Content") from your inputs (sketches, photos, text prompts, style settings, and similar).
4.2 Generated Content is provided for creative and entertainment purposes only. It is not engineering, safety, regulatory, manufacturing, or professional design advice. Outputs may be inaccurate, incomplete, inconsistent, or unsuitable for real-world use.
4.3 We do not guarantee that Generated Content is unique, correct, non-infringing, or fit for any particular purpose. You are solely responsible for reviewing outputs before publishing, sharing, purchasing decisions, or commercial use.
4.4 You must not rely on Generated Content for vehicle development, homologation, advertising claims, or representations to consumers without independent verification.
5. Automotive Brands and Trademarks 5.1 The Service may let you reference automotive marques, model names, eras, body types, or styling cues as creative inputs. Names and logos shown in the app are used only to describe user-selected creative direction.
5.2 ClayLine is not affiliated with, endorsed by, or sponsored by any vehicle manufacturer, brand owner, racing series, or trademark holder. All trademarks, service marks, trade names, logos, vehicle designs, and trade dress belong to their respective owners.
5.3 Visual outputs that resemble real brands or production vehicles are user-directed creative interpretations, not official concepts, products, or communications from any manufacturer.
5.4 You must not use the Service or Generated Content to mislead anyone into believing that outputs were created, approved, licensed, or sold by a third-party brand. You must not use outputs in ways that infringe intellectual property, publicity rights, or unfair-competition laws.
5.5 Rights holders who believe content on ClayLine infringes their rights may contact us via the support channels listed in the app and at clayline.app/support. We may remove or restrict content at our discretion.
6. Your Content 6.1 Subject to applicable law and third-party provider terms, you retain rights you may have in content you create using the Service, including inputs you upload and Generated Content you produce.
6.2 You grant ClayLine a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, and transmit your content solely to operate, secure, and improve the Service (including moderation, backups, and technical support).
6.3 If you publish to the public feed or challenges, you grant other users the right to view that content within the Service. Remix and community features may allow others to build on published work as described in the product.
6.4 You represent that you have the rights to your inputs and that your use of the Service complies with applicable law.
7. Acceptable Use and Zero Tolerance
ClayLine has **zero tolerance** for objectionable content, harassment, hate speech, sexually exploitative material (especially involving minors), spam, and abusive users. Violations may result in immediate content removal, account suspension, or permanent termination.
You agree not to:
- upload unlawful, harassing, hateful, or sexually exploitative material, especially content involving minors;
- impersonate others or misrepresent affiliation with any brand or institution;
- bypass safety limits, scrape the Service, or abuse quotas or APIs;
- use the Service to train competing machine learning models, extract datasets, or systematically reproduce Service outputs at scale;
- reverse engineer, probe, or extract underlying models, prompts, or systems except as permitted by law;
- distribute malware, spam, scam links, or automated abuse;
- resell access or Markers except where expressly allowed.
8. Moderation, Reporting, and Enforcement
8.1 We may review, moderate, remove, restrict, or disable access to content or accounts where reasonably necessary to enforce these Terms, comply with law, respond to complaints from users or rights holders, protect minors, or safeguard the integrity of the Service.
8.2 **In-app reporting:** On feed posts, use **More → Report spam** or **Report content** to flag objectionable material. Reports are sent to our moderation team for review.
8.3 **Blocking:** We may block accounts that violate these Terms. When an account is blocked, that user's public posts are removed from the feed and unpublished.
8.4 You may also report concerns (including copyright, trademark, safety, abusive, or spam content) via clayline.app/support. We may act at our discretion and are not obligated to monitor all content in advance.
9. Markers, Subscriptions, and Purchases 9.1 Markers are non-transferable digital consumables used within the Service. They have no cash value, are not property, and cannot be exchanged for money except where required by law.
9.2 Some features consume Markers or require a paid subscription tier shown in the app.
9.3 Subscriptions automatically renew unless canceled through your App Store account settings before the renewal date. Billing timing, pricing, and renewal periods are shown at purchase and managed by Apple.
9.4 Purchases through Apple's App Store are governed by Apple's terms and refund policies unless mandatory law provides otherwise.
9.5 Promotional codes and grants may expire or have usage limits displayed at redemption.
9.6 We may change pricing, Marker costs, feature availability, or AI models with notice where reasonably practicable.
10. Privacy Our Privacy Policy explains how we collect, use, store, and process personal data. By using the Service, you acknowledge that your information may be processed in accordance with the Privacy Policy available at clayline.app/privacy.
11. Third-Party Services The Service relies on third-party providers (cloud hosting, AI inference, authentication, payments). Their outages or policy changes may affect availability. We are not responsible for third-party services outside our reasonable control.
12. Disclaimers THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAYLINE AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (USD $50).
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.
14. Indemnity You agree to defend and indemnify ClayLine against claims arising from your content, your use of the Service, or your breach of these Terms or third-party rights.
15. Changes to These Terms We may update these Terms. The current version will be posted at this URL with a revised "Last updated" date. Continued use after changes means you accept the updated Terms.
16. Termination You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect users and the platform.
17. Governing Law These Terms are governed by the laws of Spain, excluding conflict-of-law principles.
Any disputes relating to these Terms or the Service will be resolved exclusively in the courts of Barcelona, Spain, unless mandatory consumer protection laws in your country require otherwise.
